1. Acceptance of Terms

By accessing and using Abena AI SDK services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Abena AI provides artificial intelligence services including:

• Text-to-Speech (TTS): Convert text to natural-sounding speech
• Automatic Speech Recognition (ASR): Transcribe audio to text
• Translation: Translate text between multiple languages

3. API Usage and Limits

Rate Limits

• Free tier: 100 credits per month
• Pro tier: 5,000 credits per month
• Enterprise tier: 50,000 credits per month

Content Restrictions

• TTS: Maximum 500 characters per request
• ASR: Maximum 60 seconds audio duration, 1MB file size
• Translation: Maximum 1000 characters per request

4. Acceptable Use Policy

You agree not to use our services for:

• Illegal activities or content that violates laws
• Harassment, abuse, or harmful content
• Spam or unsolicited communications
• Impersonation or identity theft
• Reverse engineering or attempting to extract our models
• Generating content that infringes intellectual property rights

5. Account Responsibilities

• You are responsible for maintaining the confidentiality of your API keys
• You must notify us immediately of any unauthorized use
• You are liable for all activities under your account
• Provide accurate and current information

6. Billing and Payment

Subscription Plans

• Free: $0/month - 100 credits
• Pro: $25/month - 5,000 credits
• Enterprise: $199/month - 50,000 credits

Payment Terms

• Payments are processed monthly in advance
• Credits do not roll over between billing periods
• Refunds are provided for service outages exceeding SLA
• You may cancel your subscription at any time

7. Service Availability

• Free Tier: Best effort availability
• Pro Tier: 99.5% uptime SLA
• Enterprise Tier: 99.9% uptime SLA with dedicated support

Scheduled maintenance will be announced in advance when possible.

8. Intellectual Property

• You retain ownership of your input data and content
• We retain ownership of our AI models and technology
• Generated outputs are provided under a non-exclusive license
• You grant us permission to process your data to provide services

9. Data Processing and Privacy

• Input data is processed in real-time and not stored permanently
• We do not use your data to train our models without consent
• All data transmission is encrypted

10. Disclaimers and Limitations

Service Disclaimer

Our services are provided "as is" without warranties. AI-generated content may contain errors or inaccuracies.

Limitation of Liability

Our liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

11. Termination

• Either party may terminate this agreement at any time
• We may suspend services for violations of these terms
• Upon termination, your access will be revoked
• Data will be deleted according to our retention policy

12. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or service notifications. Continued use constitutes acceptance of modified terms.

13. Governing Law

These terms are governed by the laws of Ghana. Any disputes arising from or in connection with these terms will be resolved through binding arbitration in accordance with the applicable laws of Ghana.
